Access
The site is here to support lawful browsing and purchasing without interference or misuse.
By using the site, creating an account, or placing an order, you agree to these Terms and the policies linked at checkout. You must be at least 18 years old or use the site with the involvement and permission of a parent or legal guardian who accepts these Terms.
Provide accurate information, keep credentials confidential, and notify us promptly of suspected unauthorized access. You are responsible for activity under your account to the extent permitted by law. Kane's Observations may require email confirmation or additional verification before allowing sensitive account or transaction activity.
Do not interfere with the site, evade security or purchasing limits, scrape or automate access without permission, submit malicious code, impersonate another person, misuse payment or dispute systems, infringe rights, or use the site unlawfully.
We may limit or suspend access when reasonably necessary to protect customers, the store, inventory, or service providers; investigate suspected fraud or misuse; comply with law; or maintain site security. Lawful consumer rights and existing order obligations remain unaffected.
Purchase
Collectibles can move quickly. Availability and prices reflect the store at the time shown, but may change.
Read the full listing before purchase. Product titles, descriptions, photographs, stated condition, included accessories, quantity, price, and any item-specific disclosures form part of the offer. Screen settings and lighting can affect color. Normal print, cut, centering, surface, packaging, and manufacturer variation are not defects unless the listing promises a particular standard.
Products remain subject to verified availability. Cart placement does not reserve inventory unless the site expressly confirms a reservation. Kane's Observations may enforce reasonable quantity limits and cancel duplicate, erroneous, unauthorized, fraudulent, or unfulfillable orders.
Prices, promotions, and availability may change before an order is submitted. Taxes and shipping are shown before payment when applicable. If a material pricing, description, inventory, or technical error affects a submitted order, we may cancel and refund it or ask whether you accept a clearly disclosed correction before fulfillment.
An order submission is an offer to purchase. An automated acknowledgment does not necessarily mean acceptance. Kane's Observations accepts the order when we send an acceptance or fulfillment confirmation after payment, inventory, address, and fraud checks. We will refund any payment for an order we reject or cancel.
Reserve
A preorder reserves incoming inventory. Release dates remain estimates controlled by manufacturers and distribution schedules.
A paid preorder reserves expected incoming inventory and is normally final once confirmed. Release dates, allocations, packaging, and other manufacturer-controlled details may change. The listing and checkout will state the best available shipping estimate.
Kane's Observations will provide any delay notice, renewed consent, cancellation option, or prompt refund required by applicable law. We will refund a preorder we cancel or cannot fulfill. Material product changes are handled under the Returns & Cancellations Policy.
Pay
Payment and order verification protect the customer and limited collectible inventory.
You authorize the disclosed total and represent that you may use the selected payment method. Payment information is handled by the payment processor; Kane's Observations receives transaction records needed to confirm, fulfill, refund, prevent fraud, and support the order.
We may pause, decline, or cancel an order when payment, billing, shipping, identity, inventory, sanctions, or fraud checks cannot be completed. We may request reasonable information needed to verify the transaction and will not fulfill an order that remains unverified.
You are responsible for the amount shown at checkout, including applicable tax, shipping, and clearly disclosed fees. We do not add a fee after payment without authorization, except where a carrier, customs authority, or other third party charges the customer directly.
Contact us when practical so we can review a problem promptly. Nothing in these Terms limits a lawful right to dispute a charge. We may preserve and provide relevant transaction, delivery, and communication records when responding to a payment dispute or suspected fraud.
Create
Brand assets and customer-submitted material each have clear boundaries.
The site's original text, layouts, graphics, code, product photography, logos, and branding are owned by or licensed to Kane's Observations and protected by applicable law. No rights are granted except the limited right to use the site for personal, lawful shopping and account activity.
Character names, trading-card marks, publisher marks, manufacturer marks, and other third-party intellectual property belong to their respective owners. Their appearance does not imply sponsorship unless expressly stated.
You retain ownership of material you submit. You grant Kane's Observations a nonexclusive, worldwide, royalty-free license to host, reproduce, format, and display that material only as reasonably needed to operate, moderate, promote, and improve the site and its product-review or collection features. You may delete eligible private collection content through your account.
Do not upload content that is unlawful, deceptive, infringing, abusive, malicious, private without permission, or unrelated to the feature. We may reject or remove content that violates these standards, exposes personal information, creates security risk, or is not tied to a verified purchase when verification is required.
Complete
The policies shown before payment complete the transaction record.
Processing estimates, address responsibility, carrier tracking, delays, loss, damage, and delivery claims are governed by the Shipping Policy.
Collectible merchandise is final sale except for the defined problems and nonwaivable rights in the Returns & Cancellations Policy. That policy also explains cancellation timing, preorder exceptions, authorized returns, refund method, and refund timing.
The Privacy Policy explains the information collected through browsing, accounts, orders, uploads, reviews, messages, and service providers, and how to make a privacy request.
The product listing, item-specific disclosures, accepted order summary, and policy version presented before payment govern the purchase, subject to applicable law. Keep the confirmation and inspect it promptly.
Boundary
These limits apply only to the extent the law permits them.
The site may occasionally be unavailable, delayed, or contain errors. We may maintain, change, or discontinue a site feature, but will not use a feature change to avoid an accepted order obligation.
Except for express promises in a listing, order confirmation, or applicable policy, the site and its content are provided on an “as available” basis. This does not disclaim authenticity, title, conformity, or other warranties or remedies that cannot legally be disclaimed.
To the fullest extent permitted by law, Kane's Observations is not liable for indirect, incidental, special, or consequential loss arising from site use. Nothing excludes liability or remedies that cannot legally be excluded, including responsibility for an accepted order, a required refund, fraud, willful misconduct, or legally protected consumer rights.
These Terms are governed by New York law, without overriding any mandatory consumer protection that applies to you. If a provision is unenforceable, it will be limited only as necessary and the remaining provisions will continue.
Update
Policy changes should be visible and should not rewrite an accepted order after the fact.
We may update these Terms prospectively. The effective date will change, and material changes may receive additional notice when appropriate. The Terms and policies presented for an accepted order continue to govern that order unless the customer agrees to a change or law requires it.
A delay in enforcing a provision does not waive it. These Terms, the linked policies, the accepted listing, and the order confirmation are the agreement for site use and the purchase unless Kane's Observations provides a written amendment.
